What we do – we offer our services under a membership scheme. This document details the terms and conditions of that membership.
By signing up to our exclusive membership services Product Mafia offers you an online product research service. This service offers a professional, analytical insight to products which gives you unique information about products before you buy.

Definitions

Company – “ Product Mafia Ltd”, “We”, “Us” or “Our”

CONFIDENTIAL INFORMATION – Such information which is received by You through this

Agreement which is Confidential in nature.

CONTENT – The content made available to the member through their membership.

MEMBER – “You “ or “Yours”

MEMBERSHIP – Upon payment of your monthly membership fee you become a member and are

entitled to use the Services supplied under it, subject to these terms and conditions

PARTY – Product Mafia and the Member are each a Party to this Agreement

PARTIES – Product Mafia and the member are the Parties to this Agreement

TERMS AND CONDITIONS – These terms and conditions and any other terms referred to in them,

apply to the membership and the member exclusively.

1. Acceptance of these Terms and Conditions

1.1 When you become a member and use the Site and its services, you acknowledge that You have read, understood and agree to be bound by these Terms, including the Privacy Policy, Cookie policy and The Website Terms of Use which is expressly incorporated into these Terms and Conditions, which together form an agreement that is as effective as if you had signed it. If at any time you do not agree to these Terms or you are in breach of them You and Us have the right to cancel/terminate your membership see also clause 6.

4.2 You and Not Product Mafia are responsible and fully liable for maintaining and protecting your account.
4.3 All of your membership account details must be up to date at all times, You must promptly
notify Us of any changes to your account information.

5. You agree not to misuse Product Mafia Services. You must not and must not attempt to, use the service to do the following things:-
   Probe, scan or test the vulnerability of any system or network;
   Breach or otherwise circumvent any security or authentication measure;
   Access, tamper with or use non-public areas of the service, shared areas of the service which you do not have authority to, or our service providers com outer systems;
   Interfere with or disrupt any other member host or network, for example by sending a virus, overloading, flooding, spamming, or mail bombing any part of our service;
   Plant Malware or otherwise use the service to distribute malware;

Access or search the service by means other than our publicly supported interfaces (for example scraping);
Send unsolicited communications, or motions or advertisements, or spam; send altered, deceptive or false source-identifying information, clouding “spoofing” or “phishing”;
Publish anything that is fraudulent, misleading, or infringes another rights;
Impersonate or misrepresented yourself or give false information when apply for your membership;
Violate any laws in any way or violate the privacy of others.

6. Membership Cancellation and Refund Policy

6.1 Any request to cancel your membership, must be made through the site only. This can be done by clicking on the Account button on the global navigation bar at the top of the screen, then you click on billing and there you will be able to cancel your membership. An email or telephone call will
not be accepted as a cancellation.
6.2 A request for a refund will only be actioned for the month in which the request is made, no refunds are applicable for previous months memberships. For example using the service for a three month period and then asking for a 3 month refund, this will not be agreed, no refund will be
provided.
6.2 Any member who, prior to requesting a refund, claims a refund through their payment provider eg PayPal will not be entitled to or offered any refund under any circumstances.

Service Errors

7.1 Due to the nature of the wide range of services We provide occasionally an error in listing may
occur from time to time.
7.2 Once an error is discovered We will promptly rectify the error.
7.3 We will not be liable for any error, howsoever that error arose, You acknowledge and agree that You will into be entitled to any claim, damages or compensation in respect of any error on our site or provided through out Service, including but not limited to the following:-
Any mistake as to content;
Any part of our service becoming unavailable at any time;
Any Website which can be accessed through our service any any use of your personal data by them;
Any inaccuracy of pricing information in any form.

advised of, Knew or should have known, of the [possibility thereof. Notwithstanding anything in this Agreement to the contrary, Product Mafia Limited aggregate cumulative liability here under, whether in contract, tort, negligence, misrepresentation, strict liability or otherwise, shall not exceed
an amount greater than three (3) months membership payable by the member. The Member acknowledges that any compensation paid by Product Mafia Limited under this Agreement reflects the allocation of risk set forth in this Agreement and that Product Mafia Limited would not enter into this Agreement without these limitations on its liability.

General Terms.

11.1 We confirm that We will adhere to our terms in respect of your data as per our Privacy Policy however we can not give any guarantee as to the confidentiality of the information submitted over the internet. If such information is disclosed it is entirely your responsibility and you acknowledge and accept that we have no responsibility for that disclosure.
11.2 The use of this website and to any documents to which it refers, including these Terms of Use is to be considered the entire agreement any failure to enforce the Terms of this agreement by us cannot be construed as a waiver of any of the Terms of this agreement either now or in the future.

12.2 You agree that all and any proceedings connected with this agreement shall be dealt with exclusively by the Courts of England and Wales.
